DoT warns citizens against IMEI tampering, highlights strict penalties under new telecom law

Srinagar: The Department of Telecommunications (DoT) has issued a public advisory cautioning citizens about the serious legal consequences of tampering with mobile device IMEI numbers or misusing telecom identifiers. The reminder comes amid rising concerns over the misuse of mobile devices, SIM cards, and communication identifiers in cyber fraud and other illegal activities.

According to the advisory, India’s new Telecommunications Act, 2023 imposes stringent penalties for altering IMEI numbers or using devices that carry tampered identifiers. The act prohibits modifying telecom identifiers, fraudulently obtaining SIM cards, impersonation, and possessing devices such as modems or SIM boxes that contain configurable or unauthorized IMEIs.

DoT noted that violations can attract imprisonment of up to three years, fines up to ₹50 lakh, or both. These offences are classified as cognizable and non-bailable, and similar penalties apply to anyone abetting such crimes.

The Telecom Cyber Security Rules, 2024 further ban altering IMEI numbers or producing and possessing equipment that allows such modifications.

Citizens advised to avoid risky practices

The department listed several activities that people must refrain from, including:

  • Using mobile phones with tampered or cloned IMEI numbers

  • Procuring or using devices like SIM boxes and modems with configurable IMEIs

  • Obtaining SIM cards using fake documents or impersonation

  • Giving SIM cards issued in their name to others, especially where they may be used for cyber fraud

  • Using apps or websites that alter caller identity or other telecom identifiers

The advisory warns that individuals who purchase SIM cards and hand them over for misuse can also be held liable as offenders.

Verification tools through Sanchar Saathi

DoT encouraged users to verify their mobile devices through the Sanchar Saathi portal and mobile app, which display a device’s brand, model, manufacturer, and IMEI status. The platform is part of the government’s broader initiative to strengthen the security of telecom networks and protect users from fraud.

Citizens can also use Sanchar Saathi to check their active mobile connections, report lost phones, and block stolen handsets.

The department urged the public to familiarise themselves with the provisions of the act and comply with them to ensure a safer telecom ecosystem.
