Amendments to Drugs (Prices Control) Order simplify price approvals, limit overcharging liability and speed up market launch of new medicines
NEW DELHI, July 31: The Centre has introduced a series of reforms to the Drugs (Prices Control) Order (DPCO), 2013, aimed at promoting ease of doing business, encouraging pharmaceutical innovation and improving patient access to medicines by simplifying pricing regulations and reducing compliance requirements.
The amendments, notified by the Department of Pharmaceuticals through a gazette notification dated June 30, 2026, revise several provisions of the DPCO relating to overcharging liability, approval of retail prices for new drugs and record-keeping requirements.
Under the revised rules, a drug manufacturer’s liability in cases of overcharging has been restricted to the quantity of stock that was actually overcharged by the concerned distributor, retailer or stockist, subject to compliance with the provisions of the DPCO.
The government has also relaxed the requirement for prior retail price approval for certain new drug formulations. Once the National Pharmaceutical Pricing Authority (NPPA) fixes the retail price of a new drug for one manufacturer, other existing manufacturers producing the same formulation can adopt the same or a lower price for the following 12 months without seeking fresh approval from the NPPA.
According to the government, the change is expected to reduce regulatory delays and facilitate faster introduction of medicines into the market.
The amendments also rationalise record-keeping requirements by limiting the period for maintaining records related to active pharmaceutical ingredients, bulk drugs and formulations to seven financial years immediately preceding the current financial year, replacing the earlier open-ended requirement.
To encourage innovation, the revised policy allows for separate ceiling or retail prices for the same drug where different pricing is justified on therapeutic grounds. The government said the provision is intended to support innovations that improve treatment outcomes.
Officials said the reforms would reduce compliance burden, eliminate repetitive approval processes and enable quicker availability of more effective and convenient medicines, benefiting both manufacturers and patients.
The information was provided by Minister of State for Chemicals and Fertilizers, Anupriya Patel, in a written reply in the Lok Sabha on Friday.
