Entrepreneurs allege arbitrary action by J&K Pollution Control Committee; urge Forest Minister’s intervention
Srinagar: The Federation Chamber of Industries Kashmir (FCIK) has raised strong objection to what it termed as “arbitrary and harsh legal notices” issued by the Regional Director, Kashmir, J&K Pollution Control Committee (JKPCC) to several industrial units across the Valley.
In a formal communication addressed to the Hon’ble Minister for Forest, Ecology and Environment, Government of Jammu and Kashmir, FCIK President Mr. Shahid Kamili sought immediate intervention, citing that the notices have caused “widespread distress among entrepreneurs,” particularly those operating from the Industrial Estate, Bagh-i-Ali Mardan Khan (BAMK), Srinagar.
According to the letter, most of the notices—dated October 4, 2025—contain unilateral directions for de-registration of units and use a tone that the federation described as “intimidating” and “presumptive.”
“A large number of units have received notices accusing them of operating illegally without being given any chance to be heard. This violates the principles of natural justice,” the FCIK said in its representation.
Key Concerns Raised
The federation listed several procedural and legal objections, including:

Pre-judgment of alleged violations without hearings.

Directions to de-register industrial units before any final determination.

Use of intimidating language invoking criminal penalties for minor or first-time lapses.

Misapplication of legal provisions, particularly incorrect citation of Section 5 of the Environment Protection Act, 1986.

Absence of supporting inspection reports or evidence to justify the alleged violations.

Negative impact on investor confidence and MSME morale, especially amid economic strain.
