The mutation under section 4 of the act of 1976 free from all encumbrances vests to State not to tenant. The object of introducing section 4 was to clear the encumbrances and to take over the parcels of land for further vesting of ownership rights to the tenants. So far as the question apropos death of tenants as prospective owners and devolving of prospective ownership to their lineal descendants is concerned, it is unambiguously delineated by section 42 of the Act of 1976. The lineal descendants of the prospective owners cannot be divested of their inheritable right merely on the assumption that the claims of the lineal descendants are infructuous thereto.
