Who is a “Tenant-at-Will”?

A tenant-at-will was not considered a permanent tenant, and no ownership rights automatically accrued unless explicitly transferred through legal processes.

However, under LB6 reforms, many tenant-at-will cultivators were later granted ownership if they met the cultivation and possession criteria.

Thus, a tenant-at-will could become a landowner under LB6 but not necessarily under S432, unless further legal proceedings granted such rights.

  1. The author is mistaken to construe Government Order No. S432 of 1966 with Section 432 of the Jammu and Kashmir land revenue rule. Firstly, Land revenue rules are not delineated by Sections, rules are always quoted by rules, Secondly, Jammu and Kashmir Land revenue rules don’t contain 400 or more rules in its statute. The Government order no. S432 of 1966 was promulgated in order to vest the proprietary rights to the allottees of LB-6/C of 1966 and tenants at will. So, the order of 1966 is backed with force of law rather than executive order. It has also been noticed that the revenue department and it’s executive officers expunged the entries of LB-6/C and tenants at will under the grab of the verdict titled SK Bhalla versus State of Jammu and Kashmir which is redundant and abhorrent in terms of cardinal lines observed by the Hon’ble High court which reads as “the state must evict the unauthorised occupants of the state land in accordance with law”. The allottees and others allowed to continue their possession and cultivation on State land under the State permit were necessarily to be dropped and exempted from eviction. On the contrary, the enabling provisions of the limitation Act are/were also attracted to such authorised occupants where the limitation period elapsed and the wilful neglect of the State is vividly observed to the extent of necessary Vi nec clam nec precario. The ripened and mature possession on the prohibited lands ipso facto entitle the occupants to attain the title and the applies ex proporio vigore.
