KCCI elections issue: High Court issues notice in contempt pettion

Srinagar: Jammu & Kashmir High Court on Thursday issued notices in a contempt petition filed for disobeying earlier court orders passed by the Hon’ble Court in CM No.1327/2021, 1576/2021 and 1619/2021 in CR No. 01/2021.

According to the contempt petition in which notices have been issued by the Hon’ble High Court today, it has been prayed that although the Hon’ble High Court had made it unambiguously clear that only two office bearers shall work in the capacity of being “The Care Takers” and not in the capacity of office bearers of KCCI as the Court had not conceded to the request of the office bearers to be allowed to continue. “The constitution of two member caretakers was only to the extent of making payments to employees and other monthly expenditure like electricity and rentals”, the petition prayed.

It has been further prayed that despite directions of this Hon’ble Court, the previous office bearers have been continuously projecting themselves as executive leaders of the Kashmir Chamber of Commerce and Industry and, consequently, violating the orders passed by this Hon’ble Court from time to time.

According to the petition, “In view of the clear cut mandate to the affairs of the Chamber having been entrusted by this Hon’ble Court to a Six Member Election Committee alongwith Two-Member Care Takers, the continuous projecting on part of the contemnors as being the office bearers is not only illegal but contemptuous towards the orders passed by the Hon’ble Court as well. In order to demonstrate the contemptuous attitude of the contemnors, the Petitioners placed on record various press statements as well as communications issued from time to time to the Government, which indicate that the Contemnor No.1 alongwith others is as on date acting as the president of the KCCI which is against the directions of this Hon’ble Court.”

The petition further states that in view of the above stated continuous violation of the court order, a detailed representation to the Deputy Commissioner, Srinagar was submitted in the capacity of being the Chairman of the Election Committee of Kashmir Chamber of Commerce & Industry. In terms of the said representation dated 20.04.2021, the Deputy Commissioner was informed that despite the orders of the Hon’ble High Court, the continuous projecting on part of the Contemnors as the office bearers of the KCCI is not only contemptuous but also has a tendency of misleading the general public and the members of the Chamber of Commerce as well.”

The case has been listed on 30th June, 2021.
