J&K Govt forms ‘Task Force’ for termination of govt employees

Srinagar: Jammu & Kashmir administration on Wednesday constituted a ‘Special Task Force’ for identifying and scrutinizing cases of government employees to what it called initiating the process for actions in terms of Article 311(2)(c) of the Indian Constitution.

Article 311(2)(c) of the Indian constitution stipulates “Where the President [of India] is satisfied that the retention of a person in public service is prejudicial to the security of the State, his services can be terminated without recourse to the normal procedure prescribed in Article 311 (2)”.

Pertinently, in an order issued on 30 July 2020, J&K administration had ordered to identify and create a list of government employees which it deems liable for action under Article 311(2)(c) of the Indian constitution and eventual termination.

In the latest order dated 21 April, 2021, issued by the General Administration Department, the Special Task Force shall comprise of:

Additional Director General of Police (CID), J&K; Inspector General of Police, J&K; representatives of Home Department, Law Department and the concerned department to which the employee under consideration for termination may belong to.

The issuance of this order has created a wave of anxiety across Jammu & Kashmir.

The Task Force has been tasked to scrutinize cases in a “speedy and time-bound manner”.
