4G Internet in J&K: No judgement, SC asks MHA to examine “legality”

Srinagar: Supreme Court on Monday transferered the burden of examining the legality of restrictions on Internet in J&K to a committee comprising of Secretary Home Affairs, Secretary Communication and Chief Secretary, with Secretary of Home Affairs presiding the Committee.

Although the Supreme Court did say that the order passed by the Government were non-reflective of application of mind, however, “being a protector of rights, more was required.”

“Despite procedural and substantive violations which curtail rights of residents of Jammu and Kashmir, the Government yet again comes out of it unscratched. But we believe this is not over yet”, chairman, J&K Private Schools Association, a petitioner in the case told Ziraat Times.

“It is clear that the Supreme Court has put the ball back in the court of the executive, which can use its discretionary powers to decide whether or not to make Internet, including 4G Internet, available in J&K”, a legal expert said, adding, ” It is a sad day for constitutional principles of the country.”
