New Delhi, July 24: The Government of India has reiterated that OTT platforms and social media intermediaries are legally bound to comply with the provisions of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which prohibit the transmission and publication of unlawful content.
According to the Ministry of Information and Broadcasting, Part III of the IT Rules, 2021, applicable to publishers of online curated content (OTT platforms), mandates that such publishers must not transmit any content prohibited under existing laws.
The government also highlighted that Part II of the IT Rules, 2021, imposes specific due diligence obligations on intermediaries, including social media platforms. These entities are required to make reasonable efforts to ensure that users do not display, upload, host, store, transmit, publish or share unlawful information through their services.
The clarification was provided by Minister of State for Information and Broadcasting and Parliamentary Affairs, Dr L. Murugan, in a written reply to an unstarred question raised by Rajya Sabha member Rajeev Kumar.
The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, were notified under the Information Technology Act, 2000, and continue to serve as the primary regulatory framework governing digital intermediaries and online content publishers in India.
